Whereas: The U.S. Congress and the President of these United States have failed to uphold the Fourth Amendment and its explicit protections recognized under the U.S. Constitution; and
Whereas: By failing to stop the unconstitutional activities of the NSA, they have violated the supreme law of the land and the rights of the citizens; and
Whereas: Recalling that our state government may interpose on behalf of Maryland citizens to secure their inalienable rights when the federal government is derelict in its aforementioned duties; and
Whereas: Affirming that we have a binding compact with our legislature, and it is the duty of said legislature to uphold our rights recognized under state law.
Therefore, we resolve that the State of Maryland pass the Fourth Amendment Protection Act (HB 1074) in the 2014 session of the Maryland General Assembly.
